Understanding “Agencies” Under Florida Law
In Florida, the term “agency” has a specific legal meaning under the Florida Administrative Procedure Act (APA). For professionals working in local government, public works, utilities, and regulatory compliance, understanding how agencies are defined is essential for navigating state procedures, certifications, and intergovernmental coordination.
What Is Considered an Agency?
Under the APA:
Every state department and each division within a department is considered an agency.
For example, the Department of Financial Services is an agency, and its internal divisions—such as the Consumer Services Division and the Workers’ Compensation Division—are also treated as separate agencies.
State commissions created by statute, such as the Administration Commission, are agencies.
Regional planning councils, local school boards, and other entities specified in Florida Statutes also qualify as agencies.
Even state officers, including cabinet members, the Lieutenant Governor, and the Governor (when exercising non-constitutional powers), are considered agencies under the APA.
What Is Not Considered an Agency?
The Florida Legislature and Florida Courts are not agencies.
Counties and municipalities are also not considered agencies unless a specific statute outside the APA grants them that status.
